FAQS About Party Wall Services
The Party Wall Act 1996 is a legal framework that governs work carried out on shared walls or structures between properties. It applies to residential and commercial buildings alike and is designed to protect the rights of both the building owner carrying out the works and the adjoining owner affected by them.
You are required to serve a Party Wall Notice if your works include:
- Building on or up to a boundary line
- Undertaking structural alterations to a party wall
- Excavating within 3 or 6 metres of a neighbouring property, depending on depth
- Converting a loft, extending your home, or digging foundations near an adjoining property
A Party Wall Agreement (or Party Wall Award) is required when the adjoining owner gives written dissent to the notice or fails to respond within 14 days. It is also required if you and your neighbour cannot agree informally.
Typical projects that require party wall procedures include:
- Loft conversions involving steel beams resting on party walls
- Rear or side home extensions near neighbouring structures
- Excavations for basements or foundation works
- Structural alterations such as chimney breast removals
